Terms of service

The agreement, in plain English

These terms cover how clinics use Bedside. We have kept them short and readable — if something here seems unreasonable, tell us.

1. Who these terms are between

Bedside is operated by Hamza Builds(“we”, “us”). They apply between us and the clinic or organisation whose staff use the product (“you”). By creating an account or using Bedside, you accept them.

2. What Bedside does

Bedside helps a clinic manage appointments and communicate with patients: reminders and confirmations by email, SMS and WhatsApp, a two-way inbox, tickets, secure sharing of report files, and calendar invitations. Features change as the product develops.

Bedside is not a medical device and does not provide clinical advice. It carries messages and organises schedules. Clinical decisions, and the accuracy of anything you send a patient, remain entirely yours.

3. Your account

  • You must be authorised to act for the clinic whose account you create, and you must be an adult.
  • You are responsible for who you invite and for what your staff do with the account.
  • Keep your sign-in secure. Tell us promptly if you think an account has been compromised.
  • Give us accurate details, and keep your contact address current so we can reach you.

4. Using it responsibly

The most important term on this page: you must have a proper basis for contacting every patient you message through Bedside — consent, or another lawful ground under the rules that apply to you. You must honour opt-outs, and you must not use Bedside for marketing to people who have not agreed to receive it.

You also agree not to:

  • Upload anything unlawful, or anything you have no right to share.
  • Send bulk unsolicited messages, or anything designed to deceive a recipient.
  • Attempt to access another clinic's data, probe or disrupt the service, or work around plan limits.
  • Resell or white-label the service without our written agreement.

Messages sent through WhatsApp, SMS and email are also subject to those providers' own policies. A provider can restrict or block sending — including for reasons outside our control — and we cannot override that.

5. Plans and limits

Each clinic is on a plan with a monthly allowance of reminders and WhatsApp messages, and a maximum number of clinics per account. Current plans and prices are on the pricing section. Allowances reset on the first of each month and do not roll over.

When an allowance is used up, the affected messages stop sending until the next month or an upgrade. Email reminders on the Free plan continue within its own allowance; WhatsApp is not included on Free.

There is currently no automated billing. Paid plans are arranged directly with us, no payment details are stored in the product, and nothing will ever charge you automatically. If that changes we will tell you before it applies to your account.

6. Your data stays yours

Everything you and your patients put into Bedside remains yours. We process it to run the service for you, as described in our privacy policy. We do not sell it and we do not use patient data to train machine-learning models.

Bedside is a delivery pipe, not your records archive — your own practice system should remain the master copy. Shared report files are deleted automatically when their link expires, so do not rely on us for retention.

7. Availability

We work to keep Bedside running and reminders going out on time, but the service is provided as it is, without a guaranteed uptime commitment at this stage. There may be interruptions for maintenance, and we depend on third parties — hosting, email, SMS and WhatsApp providers — whose outages affect us.

Because message delivery can be delayed or blocked by a provider, do not rely on Bedside as the only means of contacting a patient about anything time-critical or clinically urgent.

8. Ending it

You can stop using Bedside and close your account at any time, and we will delete your data on request. We may suspend or close an account that breaches these terms — particularly section 4 — or where we are required to. Where circumstances allow, we will warn you first and give you a chance to export your data.

9. Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Otherwise, and to the extent the law allows: we are not liable for lost profits, lost business, or indirect or consequential loss; and our total liability in any twelve-month period is limited to the amount you paid us for Bedside in that period. On a free plan, that amount is zero — which is a genuine reason to consider whether the service is right for critical use.

10. Changes to these terms

We may update these terms as the product develops. If a change is material we will tell clinics through the product before it takes effect. Continuing to use Bedside afterwards means you accept the updated terms.

11. Governing law

These terms are governed by the laws of India, and disputes will be handled by the courts of Karnataka, India. If you deal with us as a consumer, this does not remove protections you have under the law of your own country.
